California Governor Gavin Newsom has signed a new law that tightens the rules around mental health diversion for people accused of crimes. The legislation gives judges more authority to deny defendants entry into community-based treatment programs and instead keep them in jail while their cases move through the court system.
Under the previous framework, many defendants with diagnosed mental health conditions could argue for release into supervised treatment rather than facing incarceration. Supporters of the old system said it helped reduce jail overcrowding and provided a path to recovery for people struggling with severe mental illness. But critics argued that the rules were too lenient, allowing some individuals with violent histories to avoid jail time and reoffend while in treatment.
The new law changes the burden of proof. Now, a judge can refuse diversion if they believe the defendant poses a risk to public safety, even if a mental health professional recommends treatment. It also limits eligibility for certain serious or violent felony charges. Newsom framed the move as a balance between compassion and accountability. He stated that the state must protect communities while still offering help to those who genuinely need it.
Opponents, including some public defenders and mental health advocates, warned that the law will push more people with untreated mental illness into jails and prisons. They argue that incarceration does not address the root causes of behavior tied to psychosis or trauma. The law takes effect immediately, and its impact will likely be felt in courtrooms across California in the coming months.
