Edward Simmer is out as director of the South Carolina Department of Health and Environmental Control after failing to secure Senate confirmation. His departure stems from a 1993 state law that gives the governor authority to hire and fire agency heads, meaning Simmer's tenure automatically ended with the close of the regular legislative session.
Simmer had been serving in the role since 2021, but his appointment never received the required approval from the state Senate. Under the 1993 statute, if the Senate does not confirm an agency director by the end of the session, the position becomes vacant. Governor Henry McMaster appointed Simmer initially, but the confirmation process stalled amid political disagreements and concerns from some lawmakers over the agency's direction.
The health department oversees a wide range of public health and environmental regulations, including drinking water safety, disease control, and permitting for industrial facilities. Simmer's removal leaves the agency without a permanent leader at a time when it faces ongoing challenges, such as managing federal funding for health programs and addressing environmental concerns related to industrial pollution.
Critics of the 1993 law argue it concentrates too much power in the governor's office, while supporters say it allows for more efficient management of state agencies. For now, the department will be led by an interim director until McMaster nominates a new candidate, who will again need Senate approval. The process could reignite debates over the balance of authority between the executive and legislative branches in South Carolina.
